Not to the point where I'd throw someone in prison for jaywalking, no.  However, for murderous super criminals who torment the citizens of Gotham on a regular basis, I'd say find a more effective means of dealing with them than putting them in a mental facility whose idea of security is a screen door.

The writers really wore their political perspectives on their sleeves for THIS one.  The only way they could have made Lock-Up any more of a strawman is to have him climb to the roof of the tallest skyscraper and scream, "ME BIG BAD RIGHT WING MAN!  ME TORTURE CRIMINALS BECAUSE THEY DESERVE IT!  MOO HOO HA HA HAAA!"
