The holders of the mark HAVE to assume that they would lose protection if any other video game is using the term, so they HAVE to send out a C&D. You can’t wait to see if the USPTO is going to yank protection before you send a letter. You’re required to be very proactive.
I’m a lawyer who has gotten trademarks, as well as sent out these types of letters. On the one hand, I am a little amazed the USPTO gave out a trademark for “Wasteland.” That’s pretty generic and I’m sure the word has been used in many video games in the past.
