The parking brake has existed for over a century. The parking pawl of a modern automatic transmission is technically there as a redundant safety device to be used in concert with the parking brake. This is not the first, nor will it be the last auto shifter that somehow was not in park when the user wanted it to be.

Do you have citations for this? Did a judge determine this, or a jury? If I was on a jury deciding that, I’d never award damages because a moron didn’t use the parking brake.
