In cities where it's illegal to talk/text while driving cops should be able to confiscate phones, or at least make the driver show them their most recent calls/texts. That's hardly an infringement.

Wrong. If it costs more that 50%+ of the value to repair, a lot of insurance companies will "total it", and the only way to get it back on the road is with a salvage title. It doesn't matter if it's cosmetic or structural. Trust me, I've "totaled" several cars, and a couple of bikes.
