I think the harm is implied by the fact that it's an unwanted kiss as opposed to an unwanted light touch. I believe that this would actually qualify as sexual assault in some jurisdictions.

You have always been able to press charges against someone for unwanted touching of this nature. On a crowded, moving subway, all riders must accept that a certain amount of incidental touching will occur. Such touching is not intentional and thus not criminal.
