Hey do have liability because they’re an investment platform. They can put whatever they want in legally unenforceable TOS, but they facilitate the connection of businesses with micro-investors. Money provided is an investment by all legal definitions and one high-profile case will turn this whole world on its head.

People are, by definition, investing in a company. It won’t take long for business-friendly courts to identify that regardless of what is said by Kickstarter, they facilitate investment.
