False advertising is not the same as mistaken advertising. You have to prove intent to defraud, which is actually what VW had.

You do realize the difference between fuel economy and emissions, right? GM’s crossovers were emissions compliant all along. The AWD models just accidentally had the FWD ratings print on their stickers.

The stickers showed the ratings for FWD models. Not a hard mistake to make.

Very few customers actually bought one of those things and even looked at the mileage with any kind of concern for fuel economy.

If you are buying a crossover and expecting (or even caring about) good MPG, I have some oceanfront property in Liechtenstein to sell you.
