It makes sense. At this point, the X-Men and FF films (and their respective source IP) represent competition for Marvel’s film business. While they are forced to honor the letter of the contract they signed back in the 1990’s, they don’t have to make it easy for Fox to make money off the characters.

The beauty of the patch/eyepatch question is that the answer isn’t truly an either/or. You can have your casual glass eye for when you’re out and about taking care of day-to-day things and want to be inconspicuous, and then you can always just put on an eyepatch for when you want to look like Nick Fury.
