If you're referring to the illegal use of private servers on PCs, it's just that, illegal. Now does that stop a commited person who wants to play the game? No. But it shouldn't be illegal is what I'm arguing.

It should be a legal part of the TOS under "fair use" to allow for users to create private servers once the original servers go down. Better still, companies should re-implement more games to have user-supported servers like the original Counterstrike and Battlefield had.

This is the real issue of anything involving strategy. For it to be balanced, there needs to exist the rock-paper-scissors-lizard-spock interaction. It is usually much more complicated (at least in the great games), but the system can eventually be broken down to always know the "correct answer/counter".
