I think a hate crimes charge requires more proof than just a murder charge, so if you want to make sure to get a conviction it is easier to leave off the hate crime charge. I could be wrong though. Any criminal attorneys here?

It may not have been a hate crime. It’s important that hate crimes be taken seriously when they occur, but part of that is acknowledging that a trans person can be murdered for reasons outside their identity status.
