Nismogtr600, if he deserved to be in prison for the rest of his life, then that should have been the outcome of the trials for his more serious crimes. And since it WASN’T the outcome of those more serious trials, it shouldn’t be the result of a petty theft.

If he paid his other debts to society (which the multiple trials and sentences show must be true), then it is absolutely cruel and unusual punishment to send someone to prison (a fucking MAXIMUM SECURITY PRISON FOR AN ATTEMPTED THEFT OF GODDAMN HEDGE CLIPPERS?!?!?) for minor theft.

This is why we need prison reform. If someone is committing crimes every time they’re out of jail, it’s likely because they’ve not been prepared properly for life on the outside.

This life sentence is barbarity. Plain and simple. I need to read Justice Bryant’s dissenting opinion in its entirety but it seems dead on. Nothing further can really be said. I have serious doubts that a petition to US Supreme Court arguing 8th amendment violation would even be granted cert. 

I, for one, agree that there should be consideration of past convictions for determining the length of a new conviction. However, that should only apply to the maximum amount of length to a specific crime. For example, a crime that has a sentence time of 1 to 5 years would get the 5 years and not one more day.
