The answer to that probably differs from state to state. In Kentucky, state inmates cannot have a PC, although I think they had very limited PC access in the library for college courses. I could be wrong of course as I never worked the school, and if they did, they definitely didn't get internet access.

It is when no one else is doing that style of game and everyone is doing the same style of game that you are now doing. Even if it's copying the exact style of gameplay as the old game - it'd be the only one doing it as compared to where it stands now, it's copying the same style as about 80% of the market.
