@dj_chick: If he makes the motion, it must be granted by the judge before it would be dismissed. I honestly do not think it's likely to be granted, because I don't believe that the misconduct is so outrageous that it is shocking to the universal sense of justice.
@dj_chick: But this is the very essence of justice in the adversarial system. He gets a lawyer to advocate for him, the prosecution has one, there's a judge to preside and a jury of his peers to decide.

Slight issue here - being granted an annulment does not mean that the children of that marriage are then considered bastards. The Church uses a lot of convoluted logic to come to the conclusion that as long as the putative marriage was celebrated in good faith by at least one party, the children are legitimate.
