If the first instance they told him to go to rehab and offered him leave and he denied that he had a problem or denied the offer then yes they can fire him for cause. That cause being a drunk. The law doesn’t say you can be drunk at work, only that if you are an alcoholic your employer has to give you an opportunity

I think he has a case & he should definitely sue. I would not only sue for the remainder of my contract I would sue for future compensation that could have been due and for injurious statements made that could do damage to my reputation (which is where the future compensation would come in). That’s the point I was trying to make & you’re right in that, I believe he’s stated publicly that he has a problem so he has waived his right to medical privacy in that regard.

That isn’t proof though. Appearing drunk and being drunk are two different things. Position means little, in fact, his high profile position should be taken into account so that every i is dotted and t crossed. Again it’s probably moot as they’ll most likely pay him his contract and he would have little reason to sue.

That’s correct. In all actuality he’d be foolish to sue, assuming his contract is paid out. If he gives himself time to clean up, goes on the talk shows to express remorse, and comes back with the usual bluster he should work again. If they try to not pay him though, he should and in all likelihood would sue.
