If Walmart would go so far as to sell a used 3DS as a new one, then who is to say they wouldn't reseal it?
How is it the parent's fault if the 3DS was bought new? You don't usually open the box of a new item that's going to be given as a present looking for something to be in the system's memory, your expectation is unreasonable.
