Nope. Because people who buy consoles could care less about open source. They just want something that plugs into their TV and works with no real fuss. That and (so far) steam box is just a basic gaming PC in an HTPC case. People who want that already have that and use big picture mode.

Prepaid, yes. Contract no. If T-Mo operates anything like AT&T, you can put a prepaid sim in almost anything and they generally don't care. If you're on contract, then they do care a bit more. Especially if you're talking about an iPhone.

Galaxy Nexus owner here, and while better than any bloatware ridden phone still falls short in areas mentioned. Especially battery life.

I'll be the first one to say AT&T sucks, but how is changing your friend's plan "dishonest"? Did they ever say they wouldn't change your friend's plan to a smartphone plan? Surely he didn't think he could just pop his SIM into a smartphone and have nothing happen.

This wasn't Microsoft, and they weren't combing the site. If they were doing work-at-home they likely had to use a VPN, so in essence they just laid a trail of breadcrumbs that led right to them.

If they got the information illegally, this would be a non-issue because the terminated employees would have pointed it out, but the fact that they didn't indicates that whatever method they used was completely legal and probably in the terms of their contract.

If you don't like your employers policies, leave. Don't break policy and then complain when you get punished.
