Of course it is silly, but Nintendo can't really ban the Pokemon that they put in without there being a riot. Usually overpowered pokemon are banned in tournaments, which remedies the problem. Even within the Pokemon World Tournament, an event within Black and White 2, all (I think) legendaries were banned.
