@doubtful: In civil cases such as this accusation of breach of contract, there is such thing as burden of proof. If there is a reasonable assumption that they were in fact communicating with a competitor (ie FORMING A NEW COMPANY WITH THEM), it does tend to sway the judge's favor in the opposing direction.
@doubtful: When you're accused of breaching contract by collaborating with a competitor, going ahead and forming a studio with said company is a good way to have the judge believe the evidence being presented by Activision.

@Enochrewt: Doesn't matter how much bandwidth anything takes, if service providers are not forced to maintain net neutrality, they can easily make packages that will strip these abilities out of them simply because there is no regulation preventing them.
@comics0026: Seeing that Comcast is sometimes the only option for some people in parts of the country thanks to this lack of regulation, it's a "damned if you do, damned if you don't" situation, especially in the smaller rural towns where they are the only player in town.
