I work in higher education in student conduct. I can assure you that even if Duke is not allowed to expel this student, this will not set a new precedent. If the school sets out policies, both general and specific, guaranteeing students certain due process rights, standards of fairness etc. and then fails to live up to the general principles and specific rights granted by the policies, then a judge can force them to abide by their own rules.

The student filed a civil lawsuit against Duke for (from what I can tell) not following their own rules when they expelled him. His claim was likely that he had a contractual right to not be expelled unless the university followed its own procedures to do so.
