Thats not really true. Cindy Crawford sued a photographer for selling a picture of her lips and won because it was obviously her because of the mole. I'd be surprised if that case was not cited in this one.

I think the problem is more the fact that they should have done this to start. I mean how many years have people been complaining about not having two sticks on their psp? It should have been a no brainer and would have eliminated all the negative rants that are rising up because of it.

What I don't get is why it doesn't just read our birthday from our profile.

Most of the games that have been delayed are niche games. People are not likely to run out and spend 210 bucks for a harvest moon game. The system doesn't just need more games. It needs the ones that people "can't live without."

If they release now though they risk loosing a ton of money because not many people will buy it. Also, in say 3-4 months maybe the 3ds starts selling but they released their game now. When people go shopping the advertisement for their game is probably already done and no longer going to be in peoples heads.

Listen to the same song all day for a month because that is basically what Nintendo is selling you.
