Did you read the story? Square was in touch with the team back when we all thought the patch was going to be out in August. Sky surprised everyone and released it two months early. Square sending out a C&D this month isn't really "late in the game."

I'd understand if they were releasing a Vita version, but PS4 and X1? That still leaves out all the handheld fans. Should've left the fan translation to do their own thing, on a 3 year old game.
