I quickly put together a course for modern jets. They still have to fly this at the current alt that the races are run. Ya we might loose a few but it will be worth it. FAA controls airspace, so yes this falls into their area and out of the local cops. It would be interesting to see if this still could also be inviolation of local laws. But that is a side point. FAA takes care of airspace because it would be a total mess if each state handled its own.
