They *don’t* have the sensor data to determine if his hands were on the wheel. When I use autopilot, I always keep my hands on the wheel, but every few minutes the car demands I put my hands on the wheel... it’s only satisfied that I’m holding the wheel when I give it a solid jerk to the side.

Still, the car shouldn’t have veered off like that. So while its his fault for not having his hands on the wheel in case of an error, Tesla needs to take responsibility for a car suddenly veering off and not braking after contact as that part is the car’s fault. Yes it is in beta, yes the driver should have his hands…
