Anyone can claim that they are an oe-style cat. The only real way to know if an aftermarket catalyst performs in such a way that it conforms to EPA pollution guidelines is to have it CARB certified.
If it is the EXACT same part inside and out, then you are paying for the CARB certification which can cost millions.
It probably isn’t the same catalyst inside of it, and the old catalyst would not clean up the exhaust to OE standards. Now that it is CARB-certified, it will. More platinum, more money.
You’re thinking CARB (California Air Resource Board). CAFE is Corporate Average Fuel Economy, which is a weighted fleetwide average of fuel economy for each manufacturer.

I’ve heard that the N54 suffers from early (70-80k) turbo failure, but all that before 30k? Wow...
California is starting to install multi-spectral cameras with viz-band cameras on highway on-ramps and offramps to catch people that do this. The multi-spectral cameras can measure pollutants coming from the exhaust and then they use the viz-band cameras to take pictures of the license plates.
