You can’t have people work for free. If you’re not paying them, you’ve basically laid them off. So they can get unemployment. You can’t hand-wave the issue away by not actually saying “you’re laid off because we’re broke.”

Not paying them is not. Delaying paying is usually not considered illegal, provided they come through in a timely fashion. But if they delay without good reason, there could be some problems.

At least in CA, the (ex-)employees file a complaint with the Labor Department, and when Fyre goes Bankrupt, they have a priority claim for any available assets.

Everyone who worked there should immediately stop working and file for unemployment. They’ll never get their wages because this company is headed for bankruptcy for sure, but unemployment will be something. But don’t do any work until your wages are caught up.

It varies by state. In CA, you must be paid all wages due within a couple of days of being terminated (fired or laid off). If you quit, they get like 30 days or something.

Timeliness of pay is usually covered by state law and only a couple have monthly payments required (most are less), but the BS is in the answer:
