That would be poor legal advice. Payroll is usually first in line in bankruptcy cases, so they would be better off paying people and not having any money left to pay out suits. Plus the suits aren’t going to be completed any time soon, whereas their state department of labor can act more quickly on the payroll issue…
Many states also recognize “constructive dismissal” for unemployment, which is essentially a working condition that’s so shitty a reasonable employee would have to quit. Not being paid certainly qualifies.
