The Baltimore cops were charged with “depraved heart” (aka depraved indifference) murder, so neither premeditation nor malice needed to be proven. It’s essentially super-manslaughter, although a lot of the commentary I’ve seen thinks it was still an overcharge.
Not a lawyer, but from what I understand it takes more than some talk show appearances to be public figure as far as defamation law is concerned. And being an involuntary figure, at least originally, would also make things less clear. It’s not a slamdunk win for CBS, is my point.

Caveat that I’m not an expert on this case, but it appears that it was not a stillbirth as the Jez article says. Or at least the state successfully argued that it wasn’t actually a stillbirth and the fetus/baby was born alive. So presumably the neglect charge flows from that.
