Right, it's probably legal to ask about convictions, but illegal to ask about arrests. So if Idol was asking about arrests, they broke the law, hence the lawsuit.

The law is probably against asking whether a potential employee has been arrested (meaning that Idol was the one committing the violation). Legislating against employing anyone with an arrest record seems...unlikely.
