I'm not sure it will be called that in the west. Bear in mind the name in japan uses the English word "new", not the Japanese word for new "atarashi" - so less chance of confusion there. When it is announced in the west, I wouldn't be surprised for it to be called 3DS+ or 3DSi or something.

Yes, this. Disney (as owner of Lucasfilm) owns the copyrights to the films 100%. Fox has the exclusive distribution rights. So both companies would need to be involved for a release.
