Mr. Comstock, I believe you are referring to Illinois Criminal Code section 14, and you’ve done a fine job of explaining it here and defending your analysis, but this matter would be handled in civil court.

I’d also like to add that, in all likelihood, their starting the car automatically turned on said camera--so really they consented because they themselves turned the camera on (a camera that was, again, in plain view and could easily have been turned off/disabled).

They impliedly consented to the recording at the very least. Most likely it was obvious that the camera was on and in plain view of the perpetrators.

The camera wasn’t hidden, so they had no reasonable expectation of privacy—especially in someone else’s car that they didn’t have permission to be using for this purpose.
