The difference here is case 1 isn't exactly legal. Case 2 is PERFECTLY legal under the first sale doctrine. The used game industry is a legal industry. If developers and publishers have such an issue with it, well they'll have to do something about the doctrine first.

You're also neglecting to mention the fact that the profit margin for a used Xbox One game will only leave around $3.25 in retailer's hands per used game. Why bother? Most retailers might just refuse to stock used Xbox One games altogether.
