First, locking up a victim is worse than a rapist going free. Not only is it cruel and needless punishment of an innocent person, it will even further deter people from coming forward in the future. Second who the fuck cares which is worse? As if we have to accept one or the other.

Not to mention that when you convict the wrong person, not just do you take away someone's liberty, you're STILL letting a guilty person go free. Better to risk people getting away with crimes, than to risk people getting away with crimes AND locking up innocent people.
These kinds of binaries also allow us to be free of examining the inherent biases and problems within our system. When we restrict ourselves to asking which is worse, we eliminate the process of questioning why we are in a position to choose those binary options in the first place.

I am really uncomfortable with the idea that there are prosecutors trying to lower the standard from "beyond a reasonable doubt." That's not ok.

Prosecutors in my current city issued a material witness warrant for a rape victim and held her in jail for several days this past summer I believe as well. She was the victim of a gang rape and was terrified to go to court... so they arrested her.
