The fact that you’re hoping somebody tears this guy a new asshole when all he’s doing is offering reasonable advice with a nice heap of stuff that you certainly disagree with but is ultimately harmless says far more about you than him, and I say this as an agnostic.

Procedures can vary widely from state to state, and the federal system is its own separate entity. What you’ve linked are the federal sentencing guidelines, which wouldn’t apply in a California case like this one.

Juries typically do not sentence, judges do sentencing. After they return a verdict, the juries job is done—they are not even allowed to know what the potential jail time of the charge is. I know this because I’m a criminal trial attorney.

If we take away judicial perogative, we get bullshit like mandatory minimums and “three strikes” nonsense.
