Exactly. No one disputes that passing over a double yellow is illegal, but that in no way justifies the driver’s actions. And honestly, I’m sure a court of law will feel the same way.

I’m honestly shocked that there’s so much disagreement in the comments here. Yes the motorcyclist passed on a double yellow and yes that is illegal. Feel free to argue about whether or not is was safe, unsafe, justified, good idea, bad idea, or whatever.

Every time one of these videos get posted, the victim blaming begins. I don’t care what kind of laws the motorcyclist is breaking: trying to kill them with your goddamn car is not even remotely justified. Passing over a double yellow is a traffic violation. Damn, the write up doesn’t quite convey the “so f’n what” attitude of the driver as well as the video does. The guys first words were “what were you doing passing in a no passing zone?”, rather than showing any regard for the riders condition. Sure. No reason they shouldn’t be. But the motorcyclist’s driving wasn’t the cause of this collision. You cannot remove complete culpability from the driver of the car just because the rider was being “dumb.” His action was malicious and intentional. His punishment, hopefully, will be far more severe.

The double yellow is more for oncoming traffic danger, not danger from the people in your lane being inhuman pieces of shit.

That’s pretty much a clear case of attempted murder. If the person in the car would have shot at the pair on the motorcycle, it would be no different besides the immediate call for gun control.

Here in Ontario that motorcycle’s pass would be entirely legal. Here a solid yellow/double yellow is a not recommended passing zone, but doesn’t legally mean that you can’t pass.
