Sure. No reason they shouldn’t be. But the motorcyclist’s driving wasn’t the cause of this collision. You cannot remove complete culpability from the driver of the car just because the rider was being “dumb.” His action was malicious and intentional. His punishment, hopefully, will be far more severe.

The double yellow is more for oncoming traffic danger, not danger from the people in your lane being inhuman pieces of shit.

That’s pretty much a clear case of attempted murder. If the person in the car would have shot at the pair on the motorcycle, it would be no different besides the immediate call for gun control.

Here in Ontario that motorcycle’s pass would be entirely legal. Here a solid yellow/double yellow is a not recommended passing zone, but doesn’t legally mean that you can’t pass.
