The fact that her lawyer is doing the right thing by attempting it as a defense doesn’t mean that it will or should work. It’s not reprehensible, it’s just hopefully unworkable, because that’s not how the 1st amendment works. But if I were her lawyer, that is the defense that I would attempt because it’s the only one…
