the problem is likely that this was prior to Sony deciding to contest the merger. So he hadn’t realized that he would have to lie when he said it and certainly wasn’t expecting to have to hand over those messages during discovery for that merger. that’s how a lot of this shit goes down.

yes, they’re innocent until proven guilty, so the judge treats usually w/ some modicum of decency before they are found guilty or exonerated. not uncommon at all
