I think that is an over-simplification; in law there is a process to determine capacity to consent that has usage past sexual assault allegations. Being too drunk to consent means you can’t sign a contract, complete a verbal agreement, assent to a search or waive legal rights, etc. I think there are plenty of cases…

It only says she called him mentally ill; but the headline describes him as mentally disabled. Which isn’t necessarily wrong, although for many years advocates of various sorts have pushed others to stop using the term ‘disabled.’

You didn’t list manic schizophrenia as a diagnosis; I imagine if you were to have that condition or know some people who do, you might be more open to describing it as a disability.
