This is pedantic in the extreme, but this always bothers me whenever I watch that movie or see this in similar references: the thumbs down sign in this context historically meant the loser did NOT have to be killed by the winner.

That's an interesting straw-man argument. While it may be true that DRM doesn't always have the intended effect and doesn't always make consumer experiences better, that doesn't change the intention of the technology (which is to protect both the consumer's investment and the industry's investment).
