I see your point, but I'd like to raise one sentence "Fair use law is intentionally vague and can't be determined without taking it to court". Perhaps this is the problem? The matter is so unbelievably grey that people are confused.

Automatic/Robocalls - unless you opt-in, like for school closing updates, notifications from the city, etc., - are illegal under US law (for whatever reason we exclude politicians from this).
I think the problem is that no matter what happens, the result ends up being similar. Once a service gets to a certain size, no business wants to deal with the ordeal of 10,000 copyright holders a day yelling at them to take their IP down.
