Stop trying to spin this as anything but theft. The guy knew that there was an error, and he continued to keep going back and take more money out. It doesn't matter if BOA's ATM is all dicked up, the guy knew what he was doing was wrong, and continued to do it.
He didn't "find" it. He knew he didn't have it, and readily took it. That's theft.

This is the more fun debate here. Figuring good behavior, and assuming he's not exactly going to federal pound me in the add prison, he'll serve what, 6-8 months in a minimum security prison? That might be worth $1.5 million to me. The criminal record would suck to carry around with you.
