I think the issue is that we don’t know why Delta kicked him off the flight. He claims it was because he was speaking Arabic. But that’s not on the video. I guess it’s just hard to take the word of a YouTube prankster with a history of profiling related hoaxes seriously without corroborating.

The video starts with him saying, “I’m uploading this to Facebook.” I’d imagine people don’t want to be in some dudes viral video. Your projections are always just reinforcing your own world view. Many people just don’t want to be on some yelling dudes internet video.

Hold up. There’s no proof he WAS kicked off the plane for speaking Arabic. That’s something that only he has said and no one has backed him up on it. He could have just acted like a tool, then made up the rest as he got kicked off.
This is a bad lawsuit and the lawyers involved should feel bad.
