To be fair, yes, the company needs a disclaimer to protect itself. However, if an end user requires a disclaimer for this, then that person's issues likely run deeper than a disclaimer will be able to help.

It's not the pharma's that are charging so much. I can buy aspirin from the chemist or just about anywhere else, and it is very cheap.

Yes, you can talk and surf on a 4G phone "while" in a 4G area...which is very limited depending on where you live. When not on WiMax, the same no data and talk apply as any other CDMA phone.
