Well if it were according the letter of the rule (posted by OP), it would matter because it would fall outside of the scope of the rule (i.e., not a penalty - regardless of potential for harm or dirtiness of play) - since he is more using the side of his helmet, but of course it appears that there is more to the rule.
These data sets are probably actually pretty clean and somewhat readily available. Police shooting data OTOH is often purposefully obscured, fragmented and/or protected.
