I don't really understand the point here - the picture of the dress is definitively light blue and brown. Determining what color the dress actually is totally depends on how the picture was taken - I see how it could be white and gold, but not black and blue unless the photo was altered or intentionally color balanced…

It's just a different statute. I'm not sure about Kentucky, but in many states the laws are exactly the same, except rape relates to "sexual intercourse" (vaginal penetration) and sodomy relates to "deviate sexual intercourse" (oral or anal penetration).
I'm sure it would (and should) depend on the evidence. If it's a "he said, she said" case, that's very different from a case where there's significant evidence lining up against the accused (especially if there's two separate allegations from one night). We don't know which this is yet, but given the way the police…
There's nothing unconstitutional about having laws against forcible sodomy that are separate from rape laws - the only part that is unconstitutional is when consensual sodomy is made illegal. It's actually quite common - it's just two different statutes, which would be why they're two distinct charges.
That's pretty standard language, many states (including NY) have the exact same language.
