This is surprising to me. I thought everyone lost confidence in college. You go in thinking you are the shit and come out realizing that the world is a cold, horrible place and you are not that smart or special.
Ah I wasn't aware of this. I just googled it and apparently similar cases have been overturned and re-sentenced (I found one of a young defendent that was given under the mandatory minimum sentence for distributing pictures of his underage girlfriend). Hopefully the same thing will happen here then.
Right, but he was already sentenced again under the regular law which doesn't have the possibility of re-sentencing, yes? If he breaks the terms of his probation then he can definitely go back to jail though.
At least he has a loooong time on probation. More chances to mess up and go back to jail. I know a lot of people are saying, "why doesn't a judge re-sentence him, this is ridiculous," but in our justice system it just can't happen. If it could, the government would make awesome plea deals to get you to cooperate…

I think we might be surprised if we asked the same questions in the US and got a similar result, especially the "because she was their wife or girlfriend" one. I think that is a lot more common than people like to admit.
I can't speak to the article, but there are lots of things you can do to children that would be illegal if you did it to an adult. Private schools can corporally punish you if your parents agree to it. Obviously no kid is going to consent to getting smacked. You can bodily restrain a kid and it's okay.
