I just found out that is true in California. In my state, and the majority of states, it is just enough that she is underage. Even if the accused had every reason to believe the victim was overage, in most states that is not a defense.

I think, as other people have said, it goes to the idea that he thought she was 18 (since you have to be 18 to be a stripper). Although, legally that doesn't matter because you don't have to have intent to be convicted of statutory rape.

I just learned from googling though that statutory rape is a "strict liability" crime, so it doesn't matter if you think the other person is a minor, only if they actually are. Even if they lie to you, show you a fake ID, whatever, it is still statutory rape.
